GABRIEL MUKUAN

Gabriel is an Indonesian attorney and public policy and government affairs expert with experience both as a practicing lawyer and a public servant. As a practicing lawyer, Gabriel focuses on representing corporations and individuals in complex commercial and corporate matters including shareholder derivatives, arbitration and commercial and transactional litigations. Gabriel also handles civil litigation cases such breach of contract and torts. As a government official, Gabriel headed the legal division for the President's innovative skilling program - Project Management Office of Kartu Prakerja ("PMO Prakerja") under the Coordinating Ministry for Economic Affairs. In this position Gabriel was exposed to and worked with various government apparatus, led the formulations and negotiations of Presidential Regulation and Ministerial Regulation, worked with all law enforcement agencies, and navigated and solved multiple complex issues. Gabriel was also in charge of building and maintaining collaborations with various government institutions and law enforcement agencies in ensuring program's accountability and compliance. Furthermore, Gabriel was given the task to represent PMO Prakerja in negotiations and discussions with foreign governments and UN bodies for various purposes such as technical assistance, knowledge exchanges, dissimilations of Prakerja's outcomes and impacts.

Gabriel is a proven expert in analyzing complex legal issues, formulates legal arguments and provides sound advice on wide range of topics. Gabriel is skilled in researching and interpreting legal documents, resolving disputes and successfully negotiating settlements. Gabriel has been successful at analyzing and interpreting legislation and policy documents, preparing written communications and developing relationships with public officials. A persuasive and passionate communicator with excellent interpersonal skills.

• Represented PMO Prakerja in negation and discussion with UN Department of Economic and Social Affairs regarding involvement of Prakerja in the High-Level Political Forum on Sustainable Development 2023 and the SDGs Summit 2023.
• Represented PMO Prakerja as Lead Organizer during SDGs Summit Side-Event 2023.
• Coordinate with the Foreign Ministry regarding Prakerja involvement in the SDGs Summit.
• Together with the Ministry of Small and Medium Enterprise, enabling business registration for Prakerja recipients.
• Together with the Coordinating Ministry for Economic Affairs, co-lead the revision of Presidential Regulation Number 36 of 2020 concerning Work Competency Development Through Kartu Prakerja Program, resulting in the issuance of Presidential Regulation Number 113 of 2020 concerning Second Amendment to the Presidential Regulation 36 of 2020.
• Lead PMO Prakerja in formulating and negotiating points of revision for Presidential Regulation Number 36 of 2020 concerning Work Competency Development Through Kartu Prakerja Program.
• Together with the Coordinating Ministry for Economic Affairs, co-lead the revision of Coordinating Minister for Economic Affairs Regulation Number 11 of 2020 concerning Implementing Regulation of Presidential Regulation Number 36 of 2020 concerning Work Competency Development Through Kartu Prakerja Program, resulting in the issuance of Coordinating Minister for Economic Affairs Regulation Number 17 of 2022 concerning Implementing Regulation of Presidential Regulation Number 36 of 2020 concerning Work Competency Development Through Kartu Prakerja Program.
• Lead PMO Prakerja in formulating and negotiating points of revision for Coordinating Minister for Economic Affairs Regulation Number 11 of 2020 concerning Implementing Regulation of Presidential Regulation Number 36 of 2020 concerning Work Competency Development Through Kartu Prakerja Program.
• Lead PMO Prakerja in formulating and negotiating points of revision for Finance Minister Regulation Number 25 of 2020 concerning Procedures for Allocation, Budgeting, Disbursement, and Accountability of Kartu Prakerja Program Fund.
• Together with OJK and the Indonesian Central Bank in clarifying the regulation related to private banks joining Prakerja ecosystem.
• Lead PMO Prakerja in discussion with the Attorney General Office for Civil and State Administration (Jamdatun), in the formulation of legal opinions in 2020 and 2022.
• Co-lead PMO Prakerja in discussions and coordination with BPK, BPKP, and KPK in ensuring accountability of Prakerja.
• Counseled in an Indonesian conglomerate an acquisition of a large FMCG company.
• Counseled an Indonesian conglomerate in a land dispute case before the Supreme Court.
• Counseled and represented an Indonesian company against a state-owned company and a foreign company, in a dispute over EPC Contract for the construction of a smelter in east Indonesia before the Singapore International Arbitration.
• Counseled a joint-venture company as contractor against a foreign company as project developer in relation to a dispute over a construction contract worth over USD 80 million filed with the Singapore International Arbitration Center.
• Counseled a subsidiary of a large Indonesian mining company in negotiation to enter into a long-term supply agreement with one of the world's largest producers of heave machinery.
• Counseled to and represented an Indonesian public technology company in an administrative dispute against a local government regarding tender termination of Electronic Road Pricing.
• Counseled to a project developer in a construction dispute against its contractor, which is a state-owned company.
• Counseled to an Indonesian company on relation to a shareholder dispute with a foreign state-owned company filed with the Singapore International Arbitration Center.
• Counseled and represented an Indonesian company in a successful hostile take-over of foreign company's majority share in a company engaging in ammonia production. The acquisition negotiation lasted for almost 2 years with multiple parallel arbitration and litigation proceedings. The transaction was closed in 2013.
• Counseled and represented a university and a foundation in a successful debt-restructuring project with large entities. A prominent Indonesian scholar founded these entities.
• Counseled and represented an Indonesian in an arbitration proceeding against a foreign company regarding Transportation and Shipment Agreement.
• Counseled a luxury international brand in a trademark infringement case in Indonesia.
• Counseled an Indonesian oil and gas company in a dispute with a state-owned company concerning cash call and cost recovery related to Production Sharing Contract.
• Counseled Adaro Capital Ltd as lender in USD100 million facility to PT Trada Alam Minera, Tbk.
